Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the nomi mobile application and related websites (the “Service”) operated by nomi (“we”, “us”, or “our”). By creating an account or using nomi, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use nomi. If you are under the age of majority where you live, you may only use the Service with the consent of a parent or legal guardian. By using nomi, you represent that you meet these requirements.

2. The Service

nomi is a couple-focused experience that lets paired partners share daily moments, conversations, challenges, streaks, and related features. Features may change over time as we improve the product.

3. Accounts and pairing

• You are responsible for activity under your account.
• You agree to provide accurate information and keep your sign-in method secure.
• Pairing connects your account with another user so you can share content privately within that relationship.
• You should only invite or accept a pair connection with someone you know and trust.

4. Your content

You retain ownership of content you submit to nomi, including messages, photos, answers, and other materials (“User Content”). By submitting User Content, you grant us a limited license to host, store, process, transmit, and display it as needed to operate and improve the Service, including sharing it with your paired partner.

You agree not to upload or share content that:

• Is illegal, harmful, abusive, harassing, or exploitative
• Infringes someone else’s rights, including privacy or IP rights
• Contains malware or attempts to disrupt the Service
• Impersonates another person or misrepresents your identity

5. Subscriptions and payments

Some features require a paid subscription. Purchases are processed by Apple through the App Store. Subscription terms, pricing, renewal, and cancellation are governed by Apple’s applicable terms and your App Store account settings. Refunds, where available, are handled by Apple according to its policies.

6. Acceptable use

You agree not to:

• Misuse the Service or attempt unauthorized access
• Scrape, reverse engineer, or interfere with the Service
• Use nomi to spam, stalk, or harm others
• Use the Service for any unlawful purpose

7. Privacy

Our collection and use of personal information is described in our Privacy Policy.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of liability

To the fullest extent permitted by law, nomi and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the claim or (b) USD $50.

10. Termination

You may stop using nomi at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. Upon termination, your right to use the Service ends, though provisions that should survive will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the Service.
